Terms & Conditions

These Terms & Conditions apply to services offered by Magic Frequency, including individual sessions, packages, programmes, online services and events.

By booking or purchasing a service from Magic Frequency, you agree to these Terms & Conditions.

Full business and contact details of the service provider can be found in the Imprint on this website.

1. Scope

Magic Frequency offers services focused on personal development, self-awareness, inner exploration and wellbeing.

Depending on the service, these may include hypnosis, regression techniques, guided meditation, coaching, reflective practices, energy work, Reiki and other personal development or spiritual practices.

The exact content, format, duration and price of a service are described on the relevant service or booking page or communicated individually before booking.

Magic Frequency reserves the right to adapt individual exercises, methods or elements of a session to the circumstances and needs of the client.

Services are available only to persons aged 18 or over unless explicitly agreed otherwise.

2. Booking and Formation of Contract

Sessions may be booked through the booking system provided, through the Magic Frequency website or directly by arrangement.

A contract is formed when a booking or purchase is confirmed.

The client is responsible for providing accurate information when making a booking.

Where a service has particular requirements or conditions, these will be communicated on the relevant service page, booking page or before the service is provided.

3. Prices and Payment

The price applicable to a service is the price communicated to the client at the time of booking or purchase.

Payment is generally made at the time of booking.

Payments may be processed through Stripe or another payment method made available by Magic Frequency. Bank transfer or payment at a later time may be agreed individually.

Where payment has not been made at the time of booking, payment remains due according to the payment arrangement communicated to the client.

For programmes or other higher-value services, payment in instalments may be agreed individually.

Unless expressly stated otherwise, an instalment arrangement divides the payment of the agreed total price and does not convert the programme into independently cancellable individual services.

4. Cancellation, Rescheduling and No-Shows

We understand that plans can change.

Individual sessions may be cancelled or rescheduled without charge when notice is given more than 48 hours before the scheduled start time.

For cancellations made less than 48 hours before the scheduled start time, the session fee is non-refundable. If payment has not yet been made, the full session fee remains due.

In the case of a no-show, the full session fee remains due.

In genuine emergencies, Magic Frequency may waive the cancellation fee. Such situations will be considered individually and reasonably.

These cancellation rules are contractual booking conditions and do not limit any mandatory statutory rights that a consumer may have, including an applicable statutory right of withdrawal.

5. Late Arrival

Clients are responsible for arriving or joining their session on time.

If a client arrives late, the session may be shortened accordingly so that subsequent appointments or commitments are not affected.

A late arrival does not normally entitle the client to an extension, partial refund or reduction of the session fee.

6. Cancellation or Rescheduling by Magic Frequency

In exceptional circumstances, Magic Frequency may need to cancel or reschedule a session.

Where this happens, the client may choose between rescheduling the session to another mutually suitable date or receiving a refund for the affected session.

Magic Frequency is not responsible for additional expenses incurred by the client in connection with a cancelled or rescheduled session, except where liability cannot legally be excluded.

7. Packages

Where a client purchases a package containing several individual sessions, the package price is generally paid upfront unless another arrangement has been agreed.

Packages must be used within 12 months from the date of purchase, unless another validity period is expressly stated at the time of purchase.

Once a package has been purchased, unused sessions are generally non-refundable, subject to any mandatory statutory consumer rights.

The cancellation and rescheduling rules in Section 4 apply separately to appointments booked as part of a package.

If a package session is cancelled less than 48 hours before its scheduled start time or the client does not attend, that session may be considered used.

8. Programmes and Instalment Payments

Some longer programmes may be offered with the option of paying in instalments.

Unless expressly agreed otherwise, an instalment plan is a payment arrangement for the full programme rather than a month-to-month subscription.

Choosing to discontinue participation after a programme has begun does not automatically cancel remaining agreed payments or create an entitlement to a refund.

Any programme-specific conditions, including duration, included sessions, payment schedule and other relevant arrangements, may be communicated separately and form part of the agreement for that programme.

Mandatory statutory consumer rights remain unaffected.

9. Events and Group Experiences

Magic Frequency may offer ceremonies, circles, workshops, gatherings or other group experiences.

The specific price, location, schedule and any event-specific cancellation or refund conditions will be communicated in connection with the particular event.

Where an event is cancelled by Magic Frequency and no suitable alternative is offered or accepted, amounts paid for the cancelled event will be refunded.

Certain services relating to leisure activities that are scheduled for a specific date or period may be excluded from the statutory right of withdrawal where applicable law provides such an exception.

10. Statutory Right of Withdrawal for Consumers

If you are a consumer entering into a contract with Magic Frequency at a distance, for example online, you may have a statutory right to withdraw from the contract within 14 days without giving a reason, unless a legal exception applies.

The withdrawal period generally begins on the date the service contract is concluded.

To exercise the right of withdrawal, you must inform Magic Frequency of your decision through a clear statement, for example by email to the contact address provided in the Imprint, or through any withdrawal function provided on the website.

You may use the model withdrawal form provided below, but you are not required to use that form.

Services beginning within the 14-day withdrawal period

You may request that Magic Frequency begin providing a service before the 14-day withdrawal period has expired.

Where you expressly request that performance begin during the withdrawal period and subsequently exercise your right of withdrawal before the service has been fully performed, you may be required to pay an amount proportionate to the services already provided up to the time you communicate your withdrawal.

Where a paid service has been fully performed following your prior express request that performance begin during the withdrawal period, and where the legal requirements for loss of the withdrawal right are fulfilled, you may no longer have a statutory right to withdraw from that completed service.

Nothing in these Terms & Conditions is intended to exclude or restrict a mandatory consumer right.

11. Nature of the Services

Magic Frequency services are intended for personal development, self-exploration, reflection, spiritual exploration and wellbeing.

They are not medical treatment, psychotherapy, psychiatric care or a substitute for diagnosis, treatment or advice from a qualified healthcare professional.

Magic Frequency does not diagnose or treat medical or mental health conditions and does not advise clients to discontinue or modify prescribed medication or medical treatment.

If you have concerns about your physical or mental health, you are responsible for seeking appropriate advice from a qualified healthcare professional.

If you are currently receiving medical, psychiatric or psychological treatment, you remain responsible for determining, together with the appropriate professional where necessary, whether participation in a particular Magic Frequency service is suitable for you.

12. Personal Responsibility and Participation

The work offered by Magic Frequency is collaborative in nature.

Clients remain responsible for their own choices, decisions, actions and wellbeing before, during and after a session.

Clients are encouraged to participate openly and honestly and to communicate relevant information that may affect their experience or the suitability of a particular practice.

You are responsible for communicating if you feel uncomfortable, wish to pause an exercise or do not wish to participate in a particular practice.

You remain free to stop or decline an exercise at any time.

13. Results and Outcomes

Personal development and inner work are individual processes.

Magic Frequency does not guarantee any particular emotional, personal, spiritual, professional, relationship, health or other outcome from a session, programme or practice.

At the same time, the absence of a guarantee is not a statement about what may be possible. Sessions are intended to create space for meaningful insight, transformation and change, and profound experiences are possible. The nature and extent of any experience or change will differ from person to person.

Results may depend on many factors, including participation, circumstances, readiness, integration and choices made outside the sessions.

14. Session Recordings and Fathom

Sessions may be recorded using Fathom or another recording or transcription service so that clients can revisit insights, reflections and information from their sessions after the session has ended.

Clients who do not wish their session to be recorded should inform Magic Frequency before the session begins.

Where a session is recorded, personal information contained in the recording or transcript may be processed by the relevant technology provider. Further information about the processing of personal data, recordings and transcripts is provided in the Privacy Policy.

A recording is intended primarily as a resource for the individual client. Unless otherwise agreed, clients should not commercially reproduce, publish, distribute or present Magic Frequency's proprietary session materials, exercises or content as their own.

Separate consent will be obtained where identifiable client material is intended to be used publicly for testimonials, marketing, teaching or other purposes not necessary for providing the service.

15. Online Sessions

For online sessions, clients are responsible for having a suitable device, a reasonably stable internet connection and an environment in which they can participate safely and with an appropriate level of privacy.

Magic Frequency is not responsible for interruptions caused by the client's equipment, internet connection or environment.

If significant technical problems prevent a session from taking place, Magic Frequency and the client will seek a reasonable solution, which may include rescheduling the affected part of the session.

16. Confidentiality

Personal information shared during individual sessions will be treated with respect and the highest confidentiality.

Information may be processed by service providers where necessary for the provision of the service, including scheduling, payment, recording or transcription services, as described in the Privacy Policy.

Information may also be disclosed where required by law or where another overriding legal obligation applies.

17. Intellectual Property

Materials created and provided by Magic Frequency, including written materials, exercises, meditations, recordings created by Magic Frequency, course content and other original materials, remain protected by applicable intellectual property law.

Unless expressly agreed otherwise, materials provided to clients are for their personal, non-commercial use.

They may not be reproduced, sold, commercially distributed or presented as the client's own work without prior permission.

18. Liability

Magic Frequency will provide its services with reasonable care and professionalism.

Clients remain responsible for their own decisions, actions and use of the information, experiences and insights arising from sessions.

To the extent permitted by applicable law, Magic Frequency is not liable for indirect or consequential losses arising from decisions or actions taken independently by a client following a session.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law, nor does it restrict mandatory consumer rights.

19. Written Complaints

If you are dissatisfied with a service, you are encouraged to contact Magic Frequency so that the matter can first be addressed directly.

Consumers may submit a written complaint using the contact details provided in the Imprint.

Magic Frequency will acknowledge and respond to consumer complaints within the period required by applicable law.

Consumers may also have access to competent alternative dispute resolution bodies and other consumer protection mechanisms where a dispute cannot be resolved directly.

20. Personal Data

Personal data is processed in accordance with the Magic Frequency Privacy Policy.

The Privacy Policy explains what information is collected, the purposes and legal bases for processing, the service providers involved, international data transfers, retention periods and your rights under applicable data protection law.

21. Changes to These Terms

Magic Frequency may update these Terms & Conditions where reasonably necessary, including in response to changes in services, business practices or applicable law.

The version applicable to a particular booking is generally the version in effect when the booking or purchase was made.

22. Governing Law and Mandatory Consumer Rights

These Terms & Conditions are governed by Croatian law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law that would otherwise be applicable.

The parties are encouraged to attempt to resolve disagreements directly and amicably before pursuing formal dispute resolution.

Nothing in these Terms & Conditions limits rights that cannot legally be waived or restricted.
